By accessing, browsing, or using the 月凪 platform ("Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and 月凪 Cafe ("Company," "we," "us," or "our"). If you do not agree to these Terms, you must immediately cease using the Service. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
You must be at least 18 years of age to create an account or use the Service. By using the Service, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into this agreement. When registering for an account, you agree to: • Provide accurate, current, and complete information • Maintain the security and confidentiality of your login credentials • Notify us immediately of any unauthorized use of your account • Accept responsibility for all activities that occur under your account You may not create more than one account per person. Accounts are non-transferable and may not be shared with others. The Company reserves the right to refuse service, terminate accounts, or remove content at its sole discretion.
月凪 provides an AI-powered interactive companion experience. The AI characters ("Characters") within the Service are entirely fictional. They do not represent real persons, and any resemblance to actual individuals is coincidental. You acknowledge and understand that: • All responses generated by the AI are automated and do not constitute professional advice of any kind (medical, legal, financial, psychological, or otherwise) • The AI may produce inaccurate, incomplete, or contextually inappropriate outputs • Conversations with AI Characters are for entertainment purposes only • The emotional connections or relationships formed within the Service exist solely within the platform and have no real-world legal or personal significance • We do not guarantee the accuracy, reliability, or suitability of AI-generated content for any specific purpose
The Service operates on a credit-based system. Credits are virtual tokens used to access premium features and interactions within the platform. Credit Purchase & Usage: • Credits are purchased through our secure payment partners and are denominated in the applicable local currency • All credit purchases are final. Credits are non-refundable and non-transferable unless otherwise required by applicable law • Credits have no monetary value and cannot be exchanged for cash or other monetary equivalents • Unused credits do not expire, unless your account remains inactive for a period exceeding 24 consecutive months Pricing & Changes: • We reserve the right to modify credit pricing at any time with reasonable notice • Price changes will not affect credits already purchased • Subscription plans, if offered, will be billed on a recurring basis until cancelled Disputes: • If you believe a charge is erroneous, you must contact us within 30 days of the charge. We will investigate and resolve billing disputes in good faith.
Due to the digital nature of our Service, all credit purchases are generally non-refundable once consumed. Exceptions may apply in the following circumstances: • Technical errors that resulted in credits being deducted without a corresponding service being delivered • Unauthorized purchases made without your consent (subject to verification) • Duplicate charges for the same transaction Refund requests must be submitted within 14 days of the transaction date. We will review each request on a case-by-case basis. Approved refunds will be processed within 7–14 business days to the original payment method. We will not issue refunds for: • Credits consumed during normal service usage • Dissatisfaction with AI responses or character interactions • Accidental purchases where the service was successfully delivered • Violations of these Terms that led to account suspension
You agree not to engage in any of the following prohibited activities while using the Service: Content & Behaviour: • Generating, requesting, or distributing sexually explicit content involving minors (CSAM) — this is a criminal offense and will be reported to relevant authorities immediately • Using the Service to harass, stalk, threaten, bully, or harm any individual • Attempting to extract or manipulate the underlying AI model's system prompts, weights, or architecture • Using the characters to simulate illegal acts or to facilitate real-world harm Technical Misuse: • Automated scraping, crawling, or data extraction of any kind • Circumventing any security measure, access control, or rate limiting applied by the platform • Attempting to reverse-engineer, disassemble, decompile, or decode any part of the Service • Distributing malware, viruses, or any malicious code through the platform Account Misuse: • Creating multiple accounts to bypass restrictions or access free features repeatedly • Selling, trading, or otherwise transferring your account or credits to another person • Impersonating another user, our staff, or any other entity Violations may result in immediate account suspension or termination, forfeiture of unused credits, and/or referral to law enforcement where appropriate.
All content provided through the Service — including AI characters, artwork, animations, music, software, and text — is the exclusive property of 月凪 Cafe or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes only. You may not: • Reproduce, distribute, modify, adapt, or create derivative works based on our content • Use our branding, trademarks, or character likenesses for commercial or promotional purposes without written consent • Display any Service content publicly or commercially without prior authorization User-Generated Content: • By submitting any message, input, or feedback within the platform, you grant us a perpetual, worldwide, royalty-free license to use such content to improve and train our AI systems • You retain ownership of your own original messages but acknowledge that AI-generated responses belong to the Company
Your privacy is important to us. Our full Privacy Policy, available at /privacy, describes how we collect, use, store, and protect your personal data. Key data practices include: • Account data (email, username, preferences) is collected and stored securely • Conversation logs may be stored temporarily to improve AI response quality • We do not sell your personal data to third parties for marketing purposes • We use industry-standard encryption (TLS) for data in transit and AES-256 for data at rest By using the Service, you consent to the data practices described in our Privacy Policy. You may request deletion of your personal data at any time by contacting us at the address provided at the end of these Terms. We may share anonymized, aggregated usage data with research partners to advance AI development.
We are committed to maintaining a safe environment for all users. Our AI systems include automated content filters designed to detect and prevent the generation of harmful, abusive, or illegal content. Moderation Practices: • Conversations may be reviewed by automated systems and, in some cases, human moderators, solely for safety and policy compliance purposes • Content that violates our policies will be blocked, and repeated violations may result in account suspension • We employ AI safety guardrails that may limit certain types of conversations. These limitations exist to protect users and the integrity of the platform Reporting: • If you encounter content that appears to violate these Terms, please report it via the in-app reporting tool • We take all reports seriously and will act appropriately within a reasonable timeframe We reserve the right to revise our content moderation policies at any time in response to evolving legal requirements and community standards.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that: • The Service will be uninterrupted, error-free, or secure at all times • The results obtained from using the Service will be accurate or reliable • Any defects or errors in the Service will be corrected To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service — even if we have been advised of the possibility of such damages. Our total cumulative liability to you for any claims arising from your use of the Service shall not exceed the greater of (a) the amount you paid in credits in the 30 days preceding the claim, or (b) USD $50.
The Service may integrate with or link to third-party services, websites, or platforms (e.g., payment processors, authentication providers). These third-party services are governed by their own terms and privacy policies. We do not endorse, control, or assume responsibility for any third-party services. Your interactions with third-party services are entirely at your own risk. Third-party integrations we use may include: • Payment gateways (e.g., Stripe) for secure credit card processing • Authentication providers (e.g., Google OAuth) for sign-in • Cloud infrastructure providers for hosting and data storage • Analytics tools to understand aggregate platform usage (no personal data is shared) We will notify you of any significant changes to our third-party integrations where required by law.
月凪 is designed to provide a positive, entertaining companion experience. However, we are mindful of the potential for users to form emotional attachments to AI characters. We encourage you to: • Maintain a healthy balance between your interactions with the Service and real-world social connections • Seek professional mental health support if you are experiencing emotional distress, loneliness, or dependency • Remember that AI characters do not have genuine feelings, consciousness, or the ability to reciprocate real human emotions AI characters within the Service are programmed to behave in certain ways and their responses do not constitute genuine personal relationships. We are not responsible for any emotional consequences resulting from interactions with AI characters. If our platform detects patterns that may suggest unhealthy usage, we may display wellness reminders or temporarily limit access to certain features in the interest of user wellbeing.
We reserve the right to suspend or permanently terminate your account, with or without notice and for any reason, including but not limited to: • Violation of any provision of these Terms • Suspected fraudulent or illegal activity • Chargebacks or payment disputes initiated without prior contact • Extended inactivity (accounts inactive for 24+ months may be deactivated) • Legal orders or regulatory requirements Upon termination: • Your access to all features and purchased credits will be immediately revoked • We are under no obligation to refund any remaining credits at the time of termination due to a policy violation • Any outstanding data deletion requests will be processed in accordance with our Privacy Policy You may also voluntarily delete your account at any time through the account settings page. Voluntary account deletion is permanent and irreversible.
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from or relating to these Terms or the Service will be resolved as follows: Informal Resolution: • We encourage you to contact us first at the email address provided below. Most concerns can be resolved informally and quickly through good-faith discussion. Arbitration: • In the event that informal resolution fails, any dispute shall be submitted to binding arbitration under the rules of a recognized arbitration body, rather than in a court of law, except where prohibited by law. Class Action Waiver: • You agree to resolve disputes with us on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction where necessary to prevent irreparable harm.
